These terms govern your use of 23rdandmadison.com and any purchase made through it. By placing an order you agree to them. Please read them before you order, in particular the sections on couture and made to order pieces.
1. About us
This site is operated by 23RD & MADISON. References to we, us and our refer to 23RD & MADISON. References to you and your refer to the customer.
2. Orders and pricing
All orders are an offer to purchase and are accepted once payment is processed and confirmed. Prices are listed in Australian dollars unless stated otherwise and include GST where applicable. Applicable import duties and taxes are included in the price shown for your destination. We may correct pricing errors and decline or cancel an order where a genuine error has occurred, in which case any payment is refunded in full.
3. Couture and made to order
Couture and made to order pieces are produced to order, for you, once payment is received. Because production begins on order, these pieces are final sale. They cannot be changed, returned, cancelled or refunded other than where required by Australian Consumer Law. Production timelines shown on each product page are estimates, not guarantees, and may be affected by sourcing, production or shipping factors outside our control. Where a piece is required for a specific date, contact us before ordering and we will advise honestly whether it can be met.
4. Sizing, made-to-measure and fit
Couture may be made to the size selected against our published size guide or, where made-to-measure has been arranged with us in writing, to individual measurements provided and confirmed by the customer.
Made-to-measure garments are developed using the measurements supplied to us before final cut and construction. It remains the customer’s responsibility to ensure all measurements provided are accurate and to advise us promptly of any material changes before cutting begins.
Made-to-measure does not guarantee that no alterations will be required. Bodies, footwear and personal fit preferences vary, and final tailoring with a local bridal seamstress may still be recommended once the gown is received. Unless otherwise agreed in writing, the cost of final alterations is the responsibility of the customer.
Couture and made-to-measure pieces cannot be returned, exchanged or refunded on the basis of fit, except where required by Australian Consumer Law.
5. The handmade nature of our pieces
Our pieces are made by hand. Fabric, appliqué and finishing are worked individually, and slight variation in placement, texture and tone is inherent to handcraft and is not a fault. Images on the site are styled and screen colours vary, so the piece you receive may differ slightly in appearance.
6. Ready to wear returns
Ready to wear returns are accepted for store credit within 14 days of delivery, subject to the conditions set out in our Shipping & Returns policy, which forms part of these terms.
7. Faulty items
Nothing in these terms limits your rights under the Australian Consumer Law. If a piece is faulty or not as described, contact us and we will assess and resolve it in accordance with those rights.
8. Intellectual property
All content on this site, including designs, imagery, text and the 23RD & MADISON name and branding, is owned by us and may not be reproduced or used without written permission.
9. Liability
To the extent permitted by law, our liability is limited to the value of the piece purchased. We are not liable for indirect or consequential loss, or for delays or failures caused by events outside our reasonable control.
10. Governing law
These terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have jurisdiction.
